AD TUENDAM FIDEM,
by which certain norms are inserted
into the Code of Canon Law
and into the Code of Canons of the Eastern Churches

PROTECT THE FAITH of the Catholic Church against errors arising from certain members of the Christian faithful, especially from among those dedicated to the various disciplines of sacred theology, we, whose principal duty is to confirm the brethren in the faith (Lk 22:32), consider it absolutely necessary to add to the existing texts of the Code of Canon Law and the Code of Canons of the Eastern Churches, new norms which expressly impose the obligation of upholding truths proposed in a definitive way by the Magisterium of the Church, and which also establish related canonical sanctions.

1.From the first centuries to the present day, the Church has professed the truths of her faith in Christ and the mystery of his redemption. These truths were subsequently gathered into the Symbols of the faith, today known and proclaimed in common by the faithful in the solemn and festive celebration of Mass as the Apostles’ Creed or the Nicene-Constantinopolitan Creed.

This same Nicene-Constantinopolitan Creed is contained in the Profession of faith developed by the Congregation for the Doctrine of the Faith,(1) which must be made by specific members of the faithful when they receive an office, that is directly or indirectly related to deeper investigation into the truths of faith and morals, or is united to a particular power in the governance of the Church.(2)

2. The Profession of faith, which appropriately begins with the Nicene-Constantinopolitan Creed, contains three propositions or paragraphs intended to describe the truths of the Catholic faith, which the Church, in the course of time and under the guidance of the Holy Spirit “who will teach the whole truth” (Jn 16:13), has ever more deeply explored and will continue to explore.(3)

The first paragraph states: “With firm faith, I also believe everything contained in the word of God, whether written or handed down in Tradition, which the Church either by a solemn judgment or by the ordinary and universal Magisterium sets forth to be believed as divinely revealed.”(4) This paragraph appropriately confirms and is provided for in the Church’s universal legislation, in canon 750 of the Code of Canon Law(5) and canon 598 of the Code of the Canons of the Eastern Churches.(6)

The third paragraph states: “Moreover I adhere with submission of will and intellect to the teachings which either the Roman Pontiff or the College of Bishops enunciate when they exercise their authentic Magisterium, even if they do not intend to proclaim these teachings by a definitive act.”(7) This paragraph has its corresponding legislative expression in canon 752 of the Code of Canon Law(8) and canon 599 of the Code of Canons of the Eastern Churches.(9)

3. The second paragraph, however, which states “I also firmly accept and hold each and everything definitively proposed by the Church regarding teaching on faith and morals,”(10) has no corresponding canon in the Codes of the Catholic Church. This second paragraph of the Profession of faith is of utmost importance since it refers to truths that are necessarily connected to divine revelation. These truths, in the investigation of Catholic doctrine, illustrate the Divine Spirit’s particular inspiration for the Church’s deeper understanding of a truth concerning faith and morals, with which they are connected either for historical reasons or by a logical relationship.

4. Moved therefore by this need, and after careful deliberation, we have decided to overcome this lacuna in the universal law in the following way:

A) Canon 750 of the Code of Canon Law will now consist of two paragraphs; the first will present the text of the existing canon; the second will contain a new text. Thus, canon 750, in its complete form, will read:

Canon 750 – § 1. Those things are to be believed by divine and catholic faith which are contained in the word of God as it has been written or handed down by tradition, that is, in the single deposit of faith entrusted to the Church, and which are at the same time proposed as divinely revealed either by the solemn Magisterium of the Church, or by its ordinary and universal Magisterium, which in fact is manifested by the common adherence of Christ’s faithful under the guidance of the sacred Magisterium. All are therefore bound to avoid any contrary doctrines.
§ 2. Furthermore, each and everything set forth definitively by the Magisterium of the Church regarding teaching on faith and morals must be firmly accepted and held; namely, those things required for the holy keeping and faithful exposition of the deposit of faith; therefore, anyone who rejects propositions which are to be held definitively sets himself against the teaching of the Catholic Church.

Canon 1371, n. 1 of the Code of Canon Law, consequently, will receive an appropriate reference to canon 750 § 2, so that it will now read:

Canon 1371 – The following are to be punished with a just penalty:

a person who, apart from the case mentioned in canon 1364 § 1, teaches a doctrine condemned by the Roman Pontiff, or by an Ecumenical Council, or obstinately rejects the teachings mentioned in canon 750 § 2 or in canon 752 and, when warned by the Apostolic See or by the Ordinary, does not retract;

a person who in any other way does not obey the lawful command or prohibition of the Apostolic See or the Ordinary or Superior and, after being warned, persists in disobedience.

B) Canon 598 of the Code of Canons of the Eastern Churches will now have two paragraphs: the first will present the text of the existing canon and the second will contain a new text. Thus canon 598, in its complete form, will read as follows:

Canon 598 – § 1. § 2. Canon 1436 § 2 of the Code of Canons of the Eastern Churches, consequently, will receive an appropriate reference to canon 598 § 2, so that it will now read:

Canon 1436 – § 1. Whoever denies a truth which must be believed with divine and catholic faith, or who calls into doubt, or who totally repudiates the Christian faith, and does not retract after having been legitimately warned, is to be punished as a heretic or an apostate with a major excommunication; a cleric moreover can be punished with other penalties, not excluding deposition.
§ 2. In addition to these cases, whoever obstinately rejects a teaching that the Roman Pontiff or the College of Bishops, exercising the authentic Magisterium, have set forth to be held definitively, or who affirms what they have condemned as erroneous, and does not retract after having been legitimately warned, is to be punished with an appropriate penalty.

5. We order that everything decreed by us in this Apostolic Letter, given motu proprio, be established and ratified, and we prescribe that the insertions listed above be introduced into the universal legislation of the Catholic Church, that is, into the Code of Canon Law and into the Code of Canons of the Eastern Churches, all things to the contrary notwithstanding.

Comment:

Here we have a clear sign that Pope John Paul II wished Canon Law to be enforced against dissenters, heretics and apostates.  The above Motu Proprio spells it out clearly:  reject Catholic truths and you set yourself against the teaching of the Catholic Church – we are, one and all, to avoid any contrary doctrines.  Yet, Pope John Paul II himself did not apply it.  Odd. 

So, what happened?  Why was it never invoked?  Or, did I miss it?  Whatever, is there any offender (or a million) at the present time, to whom, one might think, the penalties might be applied, which Pope John Paul II inserted to strengthen Canon Law against dissenters, heretics and apostates?  Only asking, not least because Ad tuendam fidem seems to have disappeared into thin air, which is why we ask:  Ad tuendam fidem, Ad tuendam fidem… wherefore art thou, Romeo, Ad tuendam fidem ?   

Traditional-Leaning Priests Mentally Ill… Mgr Loftus (Echoing Papa Francis)

funny-mental-illness-cartoonfamily-sufferIt’s been a while since we’ve reported on the dreadful writings of Monsignor Basil Loftus, whom we dubbed “Mgr Leftus” because he has, without doubt, abandoned the Catholic Faith of 2,000 years for the newer, if manifestly fewer, modernist version. I haven’t read his column for ages, but this morning, Sunday, 22nd January, a reader insisted that I take a copy of  his latest offering, because it really is, literally, a very nasty piece of work.  Having read today’s claptrap, I thought I’d post some extracts for discussion, knowing full well that there’s no point in writing to his bishop (Diocese of Aberdeen and Diocese of Leeds – as if we don’t have enough heretics of our own up here, they brought him up from England) because both bishops totally ignored the Open Letter we sent to them, some years ago.  True to type, they have allowed him to continue, unchallenged, to attack Catholic Faith and Morals, to the great scandal of many of the faithful. Shame on them. 

You’d think, wouldn’t you, that at a time when society is emphasising that we must de-stigmatise mental illness, the Pope and Mgr Leftus would think twice about using it as a term of abuse. Wouldn’t you? But no. Far from it. 

The good Monsignor spends most of today’s column citing, with obvious approval, Pope Francis’ assertion that young men who apply for seminary “with the intention of adhering to a pre-Vatican II liturgy” (i.e. the traditional Mass) are undesirables (if not deplorables!)

Stretching back to 2015, Mgr quotes the Pope addressing a meeting of priests in the Diocese of Rome: “to ordain these types of seminarians is like placing a mortgage on the Church”  and cites the Pope’s warning to bishops a short time later that they must “think twice” when a young man is ‘too confident, rigid and fundamentalist’ telling them to beware when admitting candidates to the seminary, because ‘there are mentally ill boys who seek strong structures that can protect them, such as the police, the army and the clergy.’ [All quotes taken from Francis’ concern over liturgical young fogeys, The Catholic Times, 20 January, 2017] 

Speaking to bishops, says Mgr L, Pope Francis opined that “Tridentine-rite liturgies celebrated by priests who had never known the Church under the old rite were ‘a manifestation of moral and psychological imbalances.’  And, a delighted Mgr L goes on, the Pope warned newly appointed bishops in 2015:  “Be careful when a seminarian seeks refuge in rigidity – because underneath this there is always something bad.”

The traditional Mass is described as “its own shop window” in today’s savage attack,  not to be”reinforced”  in seminaries “or by the use of outdated episcopal carnival-costumes” (that is this terrible priest’s standard way of describing the sacred vestments). 

The entire article exudes evil. As one American bishop said (and I quoted him, with source, in our newsletter at the time) “To be indifferent to the old rite is one thing; to hate it comes straight from Hell”. 

Now, there’s a thought for the good Monsignor.  Instead of blethering on about “rigid fundamentalism” he ought to try it sometime. Would make much more interesting reading that the baloney he churns out week after week in the Anything-But-Catholic Times.

Who Are The Real Schismatics?

NUNSThe LCWR was given 5 years (starting in 2012) to implement a reform and thereby conform itself which Church doctrine and morals. What have been the results of this reform and how has the treatment of the LCWR differed from [that of]  the SSPX?

Once again, the LCWR is in the news for pretty much the same reason:

“Actions by the Leadership Conference of Women Religious (LCWR) at its latest annual assembly suggest that it may be closed to the possibility of reform, one writer on Catholic religious life has said.”[1]

This mega organization of female religious superiors was recently given this description by the Catholic News Agency:

“With some 1,500 members, the LCWR constitutes about 3% of the 57,000 women religious in the United States. However, the group says it represents 80% of American sisters since its members are leaders of their respective religious communities.”[2]

 So, what is the problem with the LCWR? After all, this organization was canonically-erected. And though it acts like the USCCB for female religious, nevertheless, “democratization” of the Church (or collegiality) is in vogue.

The “minor” problem is that this mega power of sisters acts as if it can pick and choose—as heretics are wont to do—what it wants to accept of Church doctrine and authority. This problem of the LCWR was no secret. Despite cries for bringing the dissenting sisters into conformity with Church teaching, they were winked at by the hierarchy. Finally in 2011, the Vatican ordered an Apostolic Visitation to be made by Archbishop Peter Sartain. Not surprisingly, several of the sisters immediately issued an open letter denouncing the visitation as a “witch hunt.”

Paradoxically, the New York Times simultaneously reported on the drastic decrease of priests and religious who were serving as chief executives in Catholic hospitals. For example in the 1960s, the presiding total was 770 in 796 of the nation’s ecclesiastically-run hospitals, whereas today, the figure is 8 out of 636 hospitals.[3] In retrospect, perhaps the literary denouncers should have considered the Visitation as more of a haunted house tour—with mere ghosts of sisters—than a witch hunt!

It is also interesting to note that even the Times drew the connection that the near “extinction” of sisters from hospitals was “accompanied” by the rise of feminism, the sexual revolution and changes wrought by Vatican II.

It is no surprise that the 2012 publication of the LCWR visitation report indicated serious dissent on various Church matters, not only in the doctrinal sphere on such topics as the divinity of Christ and the priesthood, but also in morality, such as on sex and gender matters.

Rather than calling the LCWR to task to immediately rectify these matters of dissent (even to sign on the dotted line), the Congregation of the Doctrine of the Faith granted Archbishop Sartain an “extension” of up to 5 years to lead a reform.

So how much of this reform has been accomplished within the past two years? Not much as can be witnessed by the recent statement of LCWR board members during its annual assembly just held in Nashville from August 12-16:

“The board members said they wanted to continue in conversation with Archbishop Sartain in order “that new ways may be created within the church [sic] for healthy discussion of differences.”[6]

 What is the implication of such a statement? That these religious have adopted the modernist tactic of “stay put and rock the boat from within”! In fact, this was confirmed by Cardinal Franc Rode in 2011, when he affirmed that there were some in religious life:

“who have chosen paths that have carried them away from communion with Christ in the Catholic Church, even though they have decided to physically “be” in the Church.”[4]

 Hence, it is clear that the LCWR is playing by the same modernist tune of “alter from within”.

Perhaps in the confusion of the post-conciliar crisis these sisters simply “can’t get” what the Catholic Church actually teaches. Such a naïve notion was debunked by Ann Carey, a noted author and contemporary expert on female religious (Sisters in Crisis and Sisters in Crisis Revisited), who just recently told CNA:

“These are educated women, and certainly they have the intellectual ability to understand the doctrinal teachings of the church… Rather than actually engaging some of the doctrinal issues involved, they tend to bring in speakers who reinforce their own views and even propose unproven theories such as ‘conscious evolution’ and ‘new cosmology’”[5]

 So there we have it—the LCWR leadership definitely knows what it is doing in dissenting with Catholic doctrines and morals, let alone Church authority.

The irony here is that the “kid-glove” treatment has been consistently applied to the blatantly dissenting and heterodox LCWR and others of this attitude during the post-conciliar era, while traditional groups such as the Society of St. Pius X, whose fidelity to the Catholic Faith is unquestionable, have received stricter treatment.

The case of the LCWR—to use their own words—is unfortunately another case of the post-conciliar double-standard: those who adhere to the “new ways” are “in” the Church, while those who stand fast with the “old ways” are to be regarded as if they are “out”.  Source

It’s almost beyond belief that there are still ignorant people out there who describe the SSPX as “schismatic” when no pope has ever said that – quite the reverse. Pope Benedict’s appointed representative said many times (5 times in one interview alone) that anyone who thinks the SSPX is in schism “does not understand the situation.”   In any case, maybe even those numpties who insist on accusing the Society of being in schism, even now as the crisis in the Church lurches from worse to catastrophic, will stop short and ask themselves why on earth the Vatican is tolerating these nuns, whose relationship with Catholic doctrine is about as solid as a bowl of ice-cream, while effectively persecuting the SSPX.  Despite the fact that even the Modernist Pope Francis has not pronounced the Society to be in schism, the continuing  irregular SSPX situation allows the less intelligent (or, at least , the less theologically literate) among us to continue to accuse them of schism. The basic question here then is… what the heck is going on?  Why are these (anything but) religious sisters being treated with kid gloves?

Letter From Liverpool: priest-dissenter to preach at pilgrimage to honour priest-martyr

The following letter arrived in the Catholic Truth post today, enclosing the parish newsletter for SS Edmund & Thomas of Canterbury, 62 Oxford Road, Waterloo, Liverpool. The newsletter carried the following advertisement:

“Holy Hand Pilgrimage”: The annual pilgrimage to venerate the holy hand of St Edmund Arrowsmith will take place on Sunday 25 August at St Oswald and St Edmund’s Church, Ashton-in-Makerfield. Mass will be celebrated at 4pm followed by veneration of the holy hand. The preacher at mass (sic) will be Fr Kevin Kelly.  (Click on image of “The Archdiocese of Liverpool” to read about Fr Kelly).

Our correspondent wrote for publication in our October newsletter, but I think this letter requires earlier publication, for reasons that will become obvious…

Dear Editor,

In the enclosed newsletter you will see a pilgrimage being advertised to venerate the holy hand of St Edmund Arrowsmith. Fr Kevin Kelly is going to preach.

In ‘The Challenge of Aids – New Predictions in Moral Theology”, Fr Kelly advocates that two men should be able to marry. In his writings he has stated that he was shocked when Humanae Vitae did not allow artificial contraception. Why he should be shocked is a surprise for the Catholic Church has always prohibited it.

St Edmund Arrowsmith ended up suffering the most terrible martyrdom for defending God’s laws on marriage. He told two Protestants who were cousins that they should not be married. He ended up in trouble as the mother of the so called “couple” reported him. (Ed: I have never heard this story before, so if anyone can provide a source, that would be much appreciated.)

It is terrible to have a priest like Fr Kevin Kelly, who is obviously trying to create a false god in the image and likeness of his own ideas, preaching at the pilgrimage in honour of St Edmund Arrowsmith, who was a staunch Catholic priest who paid the most dreadful price for (his adherence to) authentic Catholic teaching.

The mission of the Catholic Church is to hand on the teaching of the Catholic Church, not to invent one’s own theology. There are 44,000 different Protestant denominations already doing this.

St Edmund Arrowsmith lamented on the scaffold as to what was to become of England. He will surely be horrified if Fr Kevin Kelly comes to preach his gravely sinful ideas at a pilgrimage in his honour.

Fr Kevin Kelly would do well to recall the words of Blessed Jacinta of Fatima, who had seen Hell. She said: “more souls go to Hell through sins of the flesh than for any other sin.”

You will note that there is no mention on the newsletter of the parish being a Catholic Church (Ed: yes, noted.)
